2026 Gag Clause attestation process

As part of our ongoing support for the Consolidated Appropriations Act (CAA) gag clause attestation, Univera Healthcare will continue to submit the attestation on behalf of our fully insured and minimum premium groups in 2026, unless a group instructs us otherwise.

Groups that wish to opt out of Univera Healthcare’s submission must notify their account manager by December 1, 2026.

For self-funded, Rx carve-out, and Article 47 groups, Univera Healthcare provides a Certificate of Compliance, which enables these groups to submit their gag clause attestation directly to the Centers for Medicare & Medicaid Services (CMS). Certificate of Compliance documents have been distributed to applicable groups.

Please note that if a group terminated coverage during 2026, Univera Healthcare will not submit the 2026 gag clause attestation on the group's behalf. Upon request, we will provide a Certificate of Compliance so the group can submit its attestation directly to CMS.

If you or have questions about the 2026 gag clause attestation process, please contact your broker or sales representative or account manager.
